Character Commission Terms of Service

By commissioning me, you acknowledge that you have read and agree to the following Terms of Service.

1. General

- I reserve the right to decline any commission for any reason.
- All communication should remain respectful and professional.
- You must be at least 18 years old, or have permission from a parent or legal guardian, to purchase a commission.

2. Commission Process

- References must be provided before work begins. The clearer your references, the more accurate the final artwork will be.
- Major changes requested after the sketch has been approved may incur an additional fee.
- My estimated completion time will be provided when I accept your commission. Delays may occur due to personal circumstances, workload, or unforeseen events, and I will communicate these where possible.

3. Deadlines & Rush Requests

- Estimated completion times will be provided when a commission is accepted and may vary depending on workload, complexity, and personal circumstances.
- If you require your commission to be completed by a specific date, this must be communicated at the time of your request.
- Deadline requests are not guaranteed unless agreed upon before work begins.
- Commissions requiring an accelerated turnaround may incur an additional fee depending on the timeframe and complexity of the request.
- Delays caused by unforeseen circumstances will be communicated as soon as reasonably possible.

4. Payment

- Payment is required in full before work begins unless otherwise agreed.
- Payment must be made through PayPal unless an alternative method has been agreed upon beforehand. (the client is responsible for any transaction fees if applicable)
- Prices are listed in my commission information and are subject to change for future commissions.
- Additional characters, complex designs, detailed backgrounds, or significant revisions may increase the final price.
- All payments are non-refundable once work has begun, except where I am unable to complete the commission.

5. Revisions

- My current workflow does not include separate sketch or colouring approval stages, though this may change as my process evolves.
- A reasonable number of minor revisions after completion are included at no additional cost. These include small corrections such as colours, markings, or details that differ from the provided references.
- Major changes, including altering the character, pose, composition, or other substantial redraws, may incur an additional fee, be treated as a new commission, or be declined.
- Once the final revisions have been completed and the artwork has been approved, any further changes may be charged separately.

6. Copyright & Ownership

I retain full copyright and ownership of all artwork I create.Unless otherwise agreed in writing:- You receive a personal, non-exclusive licence to use the commissioned artwork.
- You may post the artwork on social media, use it as profile pictures, wallpapers, or print it for personal use.
- You must credit me as the artist whenever reasonably possible.
- You may not claim the artwork as your own.
- You may not remove my signature or watermark (if present).
- You may not edit or significantly alter the artwork without my permission.
- You may not mint, sell, or otherwise use the artwork in connection with NFTs, blockchain technologies, cryptocurrency projects, or AI training datasets.
- You may not use the artwork for commercial purposes unless you have purchased commercial usage rights.

7. Commercial Usage

Commercial use is not included in standard commission prices.Commercial rights must be negotiated separately before work begins and may incur an additional licensing fee.

8. Artist Rights

I reserve the right to:- Share commissioned artwork in my portfolio, website, and social media.
- Use commissioned artwork for promotional purposes unless a confidentiality agreement has been arranged beforehand.
- Decline future commissions from clients who violate these Terms of Service.

9. Client Responsibilities

You confirm that:- You have permission to use any reference material you provide.
- You own or have permission to commission artwork of any original characters supplied.
- You understand that artwork is created in my personal artistic style.

10. Cancellations

- If you cancel before I begin work, you may receive a full refund.
- If work has already started, refunds will be partial or unavailable depending on the amount of work completed.
- If I cancel the commission before completion, you will receive either a partial or full refund depending on the stage of completion.

11. Prohibited Use

My artwork may NOT be used:- For hate speech, discrimination, harassment, or illegal activities.
- To impersonate me or misrepresent my work.
- In AI image generation, machine learning datasets, or similar technologies without my written permission.

12. Acceptance

By submitting a form and payment, you confirm that you have read, understood, and accepted these Terms of Service.
